1. Definitions
Provider — [company name], granting access to the data search API.
Customer — a legal entity or individual who has registered an account and accepted this offer.
Request package — a purchased number of search operations with a limited period of use.
Access key — a unique string identifying the Customer when calling the API.
2. Subject of the agreement
The Provider grants the Customer programmatic access to the data search service within the volume of the purchased request package. The service is considered rendered at the moment the search result is handed to the Customer.
3. Packages and validity
Every package has the volume and validity stated in the plan at the time of purchase. Unused requests are voided when the term ends and are neither refunded nor carried over.
The Provider notifies the Customer about an approaching expiry at least 14 and 3 calendar days in advance, by the email address stated in the account.
When several packages are active, requests are spent first from the package with the earliest expiry date.
4. Payment
Payment is made in cryptocurrency against an issued invoice. The amount is fixed for the lifetime of the invoice; once it expires the invoice is void and funds arriving afterwards are handled under the “Refund policy”.
There are no recurring or automatic charges. Each package is purchased by the Customer.
If the amount received differs from the one stated in the invoice, the package is not credited automatically; the case is reviewed individually within 3 business days.
5. Charging requests
A request is taken from the package only for a completed search, that is when an answer from the data source is received, including an answer stating there are no matches.
Not charged: requests with invalid parameters, requests rejected by the shared rate limit, and requests not executed because the data source was unavailable or because of an internal error on the Provider’s side.
Charging details for each request are available to the Customer in the dashboard for the retention period of the log.
6. Access keys
The Customer creates access keys and bears full responsibility for keeping them safe. A key is displayed once, at the moment of creation.
Every request made with the Customer’s key is deemed made by the Customer. If a key is compromised, the Customer must revoke it in the dashboard immediately.
7. Limits and suspension
The Provider applies a single rate limit that is the same for all Customers and all plans, and may suspend access on suspicion of a compromised key, breach of this offer, or signs of automated abuse.
During a suspension the validity of purchased packages keeps running; no requests are charged in that period.
8. Liability
The Provider does not guarantee that data exists for any particular search and is not liable for the completeness or freshness of data supplied by the source.
Requests are executed sequentially, in the order they arrive; waiting time depends on the current queue load and is not a breach of these terms.
9. Personal data
The Customer confirms that it has a lawful basis for processing the personal data obtained through the service and is solely responsible for its further use. How the Provider processes data is described in the data processing policy.
10. Changes to the terms
The Provider may change the terms by publishing a new revision. Changes do not apply to packages already purchased: those keep the terms in force at the time of purchase.
